What Is eFNS?

This refers to the Department of Immigration Services Foreign Nationals Portal. This portal was created for foreigners to access services such as alien cards, applications for citizenship, permits, and Kenya visitors’ pass. Naturally, people have to create an eFNS account in order to access the services.

How To Create An eFNS Account

The first thing to do is to visit the eFNS registration portal. If you are a Kenyan, then you will need your ID number for registration. On the other hand, foreigners need to use their foreign certificates. If neither is available, then you shall use your passport to open the eFNS account and you will select the option for “other”.

After making the necessary selections, go ahead and create your password. Do not forget to verify your account. Once you are done, go ahead and log in to your account so that you can go through eFNS guidelines to access the services.

Accessing The Services

Once you log in successfully, you are presented with a number of options for the application. 1. Foreign Nationals Certificate (Alien Card), Re-entry Pass, Extension of Visitor’s Pass

All foreign nationals are registered as per the Kenya Citizenship and Immigration Act of 2011 part VII (56) 2 Laws of Kenya. This law states that any foreign visitor who stays in the country for more than 90 days must be registered.

Under this section, you can apply for an alien card, a re-entry pass application, and an extension of a visitor’s pass. What is alien card in Kenya? The alien card is the one that foreigners staying for more than 90 days are required to acquire.

The following people are exempted from the Foreign National Registration:

• Refugees under the 2006 Refugee Act
• A serving person in the armed forces
• Someone who is exempt from the Act under section 34(3) of the immigration law
• A public officer plus the spouse and kids
• A person who has a special pass recognized by the law

2. Permanent Residency

This application is under the Kenya Citizenship and Immigration Act, 2011, Section 37, and has four categories. The categories are as following:

• (Category A) Application of Permanent Residency by Ex-Citizens of Kenya – This is for people who were initially Kenyans by birth but changed or lost their citizenship and their countries of domicile have denied them dual citizenship. This also applies to the spouses and children of such people.
• (Category B) Application of Permanent Residency by holders of Work permits – This applies to people who have had Kenyan work permits for at least 7 years. In addition, they have been in the country continuously for three years and immediately before the application. This also applies to the spouses and children of such people.
• (Category C) Application of Permanent Residency by Children of Kenya Citizens – This is for children of Kenyan citizens born outside the nation and are, therefore, citizens of the resident countries.
• (Category D) Application of Permanent Residency by Spouses of Kenya Citizens – This section is for spouses of Kenyan citizens who have been married for at least three years.

3. Permits

A work permit is issued under the Kenya Citizenship and Immigration Act, 2011, by the Director of Immigration Services. This permit allows foreigners to come into the country to engage in business, trade, missionary activities, farming, professional employment, and even residence in the country.

The permits are issued upon the recommendation of the Permit Determination Committee. If anyone feels that the decision is not fair, they can appeal to the Cabinet Secretary who appoints the Permit Determination Committee. Note that someone can apply for an exemption from this law. Under this section, you can apply for the following permits:

• (Class A) Application – for people who want to engage in mining in Kenya either alone or as a partnership
• Class B: (Agriculture and Animal husbandry)
• Class C: (Prescribed profession) – for people of a prescribed profession and wishes to practice it in Kenya alone or as a partnership
• Class D: (Employment)
• Class F: (Specific manufacturing)
• Class G: (Specific trade, business, or consultancy)
• Class I: (Approved religious or charitable activities)
• Class K: (Ordinary residents)
• Class M: (Refugees)

4. Passes

There are three major types of passes that are issued by the Kenyan government. These are:

• Special Pass Application – This issued to people wishing to remain or enter the country for a limited time in order to conduct business, profession, or trade temporarily
• Dependant pass Kenya – This is for a person whose spouse, guardian, or parent is lawfully allowed to enter Kenya as per the Kenya Citizenship and Immigration Regulations, 2012 section 27 (1)
• Kenya Student/Internship/Research Pass Application – This is for people who wish to study in Kenya’s Education or Training Institutions where they have already been admitted.

5. Citizenship

This is the last service in the portal. Under this immigration service, you can access the following:

• Dual citizenship
• Endorsement
• Regaining Kenya Citizenship
• Citizenship by Marriage – for spouse Visa Kenya
• Widows and Widowers applications for citizenship
• Lawful Residents applications for citizenship
